Cannabis and Driving in Frankfurt

Essential information for residents, tourists, and vehicle renters regarding the new 3.5 ng/ml limit, e-scooters, and zero-tolerance policies.

What Does 3.5 ng/ml Mean?

The federal legal limit for driving under the influence of cannabis in Germany is now set at 3.5 nanograms of THC per millilitre of blood serum. Driving with a THC level at or above this threshold is an administrative offence (Ordnungswidrigkeit), penalised with significant fines and a driving ban.

Is It a Safe Driving Target?

No. The 3.5 ng/ml limit is a strict legal threshold, not a "safe consumption" guideline. Unlike alcohol, THC metabolises unpredictably. A user might feel entirely sober but still test above the legal limit days after consumption.

Important Warning

No website, app, or calculator can reliably calculate when an individual will be legally or safely fit to drive after cannabis use. Metabolism varies drastically based on body fat, frequency of use, and product potency.

Zero Tolerance Categories

Novice Drivers & Under 21s

The 3.5 ng/ml limit does not apply to new drivers. If you are in your two-year probationary period (Probezeit) or under 21 years of age, a strict zero-tolerance policy applies. Any detectable amount of THC will result in severe penalties and the extension of your probationary period.

Cannabis + Alcohol

Mixing cannabis and alcohol before driving is strictly penalised. If you have consumed cannabis (even below the 3.5 ng/ml limit), the legal alcohol limit effectively drops to 0.0 BAC. Driving under the combined influence of both substances carries exponentially higher fines.

Different Vehicles in Frankfurt

E-Scooters (TIER, Lime, Voi)

In Germany, e-scooters are legally classified as motor vehicles (Elektrokleinstfahrzeuge). Exactly the same strict DUI laws apply to riding an e-scooter as they do to driving a car.

Tourists and locals frequently lose their driving licences because they assume e-scooters are treated like bicycles. Police in Frankfurt regularly conduct sobriety checkpoints for e-scooter riders, especially at night and on weekends.

Rental Cars & Car-Sharing

When using car-sharing services (Miles, ShareNow) or renting a car (Sixt, Europcar) at Frankfurt Airport or Hauptbahnhof, you are bound by their Terms of Service. Most rental companies enforce a strict zero-tolerance policy for all drugs. Even if you are under the state's 3.5 ng/ml limit, driving a rental car with THC in your system violates the rental agreement, voiding your insurance and leaving you personally liable for any damages.

Motorcycles

Motorcycles are motor vehicles subject to the exact same 3.5 ng/ml limit, novice rules, and penalties as standard passenger cars.

Company Cars

Employers generally prohibit driving company vehicles under the influence. A DUI charge can result in immediate termination of employment contracts.

Driving Licence Consequences

If you are caught driving above the 3.5 ng/ml limit (or > 0.0 for novices/mixed with alcohol), the standard penalties usually include:

  • A fine of at least €500 (first offence).
  • A minimum one-month driving ban (Fahrverbot).
  • Points on your driving register in Flensburg.

Accidents & Criminal Charges

If you cause an accident or display signs of severe impairment while driving, you can face a criminal charge (Straftat) under § 315c or § 316 StGB, regardless of the exact nanogram measurement, leading to licence revocation and possible imprisonment.

Medical Cannabis Patients

Patients who are prescribed medical cannabis are generally exempt from the strict 3.5 ng/ml administrative limit, provided the medication is taken exactly as prescribed for a specific medical condition.

However: This is not a free pass. If a medical patient exhibits impairment or causes an accident, they are still subject to criminal prosecution. Patients are legally obliged to ensure they are fit to drive before getting behind the wheel.
